Hans G. Laimer is a founding partner at zeiler.partners. He is a dedicated specialist in all areas of employment- (including benefits-, service inventions and pension issues) and industrial relations law.

Hans’ practice encompasses both contentious and non-contentious matters and his client base ranges from small firms to listed multi-national companies across all sectors.

His expertise comprises, amongst others, advice on restructuring of businesses and transfers of undertakings, working-time issues, white-collar crime, data-protection matters, maternity- and paternity issues as well as service inventions and post-termination restrictive covenants.

He regularly assists employers in drafting employment- / management contracts, ensuring that the contracts and reward packages offered to employees are designed to incentivise employees in line with the business objectives.

Together with his clients, Hans develops industrial relations strategies and defends employers against claims by works council members. He frequently supports his clients in drafting and amending shop agreements and advices his clients on the relevant issues in connection with works councils.

He is a seasoned litigator and regularly represents clients before Austrian courts, the Ombuds for Equal Treatment / Disabled Employees and conciliation boards. Hans successfully defended employers before employment tribunals in unfair dismissal claims, discrimination cases as well as in connection with requests for re-instatement and wage-and-hour cases.

A graduate of the University of Vienna (Mag.iur. 2000; Dr.iur. 2002) and the London School of Economics (LL.M. Labour Law, 2003), he is a frequent speaker at national and international conferences on labour- and employment law. Additionally, he is a lecturer on HR-issues at the University of Applied Science BFI Vienna and author of numerous publications in the field.

Prior to co-founding zeiler.partners in 2014, Hans acted as the employment partner for a major international Vienna-based law firm. His working languages are English and German.

  • Successfully representing the client, a Spanish airline, before the Austrian courts, including the Austrian Supreme Court, in a case of an employee challenging his notice of termination for being null and void due to the client allegedly not following the prescribed procedural steps and the alleged applicability of a foreign law.
  • Ongoing support of the client, a leading multinational home improvement supplies retailing company, in all labour related matters, including the assistance in implementing a new working time scheme (flexi-time).
  • Assisting a long-standing client, a world leading chemical company, in all operative day-to-day employment law, industrial relations and pension issues. He also supported the client in all employment related aspects of a recent M&A deal (TUPE), comprising also advice in respect of the timeline for meeting the information and consultation requirements towards the works council and the protection afforded to employees in the course of a transfer of undertakings situation.
  • Representing the client, a global human proteins manufacturer, against its works council/employees in several pending cases before the employment court in matters regarding the employee’s classification in the client’s overall salary scheme. Additionally, Hans is supporting the client in a pending case before the employment court and the Ombud for Equal Treatment.
  • Ongoing representation of the client, a leading Austrian contracting business, against their previous manager in several pending law suits before the Employment Court and the Ombud for Disabled Employees (Sozialministeriumservice). The manager’s claims comprise the challenging of the notice of termination for being socially unfair and being based on an undue motif, the claim for re-instatement and the claim that the notice of termination is void due to the protected status of the employee.
  • Assisting a long-standing client, a multinational car manufacturer and seller, in all operative day-to-day employment law, industrial relations and pension issues. Such support comprises the assessment from an Austrian employment perspective of possible restructuring measures, including potential reduction in force, mergers and shut-downs of certain operations in Austria. Furthermore, Hans successfully defended the client in a case of alleged sexual harassment against potential claims of one of the employees involved.
  • Ongoing support of the client, a catholic relief, development and social service organisation, in their employment matters, including the successful representation of the client in connection with the termination of the employment contract of the chairman of the client’s works council.
